5.  Darnell A. Allen, Jr. v. Howard Painter, Commissioner of Corrections, No. 041537. Petitioner appeals from the circuit court’s order denying his petition for a writ of habeas corpus. Petitioner’s conviction of first degree murder without a recommendation of mercy was affirmed by this Court in State of West Virginia v. Allen, 203 W.Va. 9, 506 S.E.2d 46 (1998).

Petitioner employer appeals from the circuit court’s order reversing the decision of the West Virginia Education and State Employees’ Grievance Board and directing petitioner to restore all accrued sick leave, seniority, holiday pay, incremental pay, annual leave and related benefits to respondents.

8. State of West Virginia v. Robin Ladd, No. 041556. Defendant was convicted of first degree murder with mercy and two counts of conspiracy to commit murder following her second trial upon remand from this Court in State v. Ladd, 210 W.Va. 413, 557 S.E.2d 820 (2001). Defendant asserts various trial errors.

13.  State of West Virginia v. D’Risen Sean Douglass, No. 041560. Petitioner appeals his conviction for possession of a controlled substance (marijuana) with intent to deliver. He entered a conditional plea of guilty, reserving his right to appeal the denial of his motion to suppress evidence.

He asserts that a criminal charge of malicious wounding is barred by res judicata because a magistrate previously dismissed the same charge for lack of probable cause when the alleged victim failed to appear at a preliminary hearing.

28.  Rosalee Dinkarrao Dolan v. Desai, No. 041630. Petitioner files an appeal of her negligence case arising out of an auto accident. The jury returned a verdict finding that the plaintiff did not suffer any damages which were proximately caused by the accident. The Trial Court denied petitioner’s timely Motion for a New Trial.
