City of Dunbar - 32655 - The City of Dunbar appeals from the circuit court's order granting summary judgment to the Fraternal Order of Police Lodge #119 on issues surrounding a collective bargaining agreement. - This case will be called at 2:00 p.m. Justice Davis disqualified. Judge Kirkpatrick sitting by temporary assignment.
2. Reggie Lee Philyaw v. Eastern Associated Coal Corp. - 32754 - Continued.
3. Subcarrier Communications, Inc. v. Ronald E. Nield, et al. - 32752 - Defendants and third-party plaintiffs appeal from the circuit court's order awarding summary judgment in favor of plaintiff in this action to set aside a tax deed.
4. Jennifer Thomas v. Anil K. Makani, M.D., et al. - 32753 - Plaintiff in a medical malpractice case appeals an adverse jury verdict and the court's order denying a motion for new trial.
5. State of W. Va. v. James Blaine Waldron - 32693 - Defendant was convicted of voluntary manslaughter following a jury trial. He seeks a new trial.
6. In the Matter of: William Tom Toler, Magistrate for Wayne County - 31797 - Wm. Toler was suspended without pay by this Court pursuant to an indictment by Wayne County Circuit Court. Toler was found "not guilty" on 11 counts on 2/24/05.
