3. Subcarrier Communications, Inc. v. Ronald E. Nield, John B. Lusk, Patrick Lee Nield & LN&N Investments, LLC v. Neil A. Reed, et al. - 050668 - Defendants and third-party plaintiffs appeal from the circuit court's order awarding summary judgment in favor of plaintiff in this action to set aside a tax deed. - Grant 4 - 1 , Starcher.
4. State of W. Va. v. Steven Lee Walker - 050674 - Petitioner appeals his 70 year sentence for first degree robbery and the circuit court's order denying a Rule 35 motion to reconsider sentence. - Refuse 3 - 2 , Albright & Starcher.
5. Jennifer Thomas v. Anil K. Makani, MD and South Branch Surgical Associates, Inc. - 050627 - Plaintiff in a medical malpractice case appeals an adverse jury verdict and the court's order denying a motion for new trial. - Grant 5 - 0 as to issue #1 only.
6. Reggie Lee Philyaw v. Eastern Associated Coal Corp. - 050764 - Petitioner files a direct appeal from the circuit court's order granting summary judgment to Eastern Associated Coal. Petitioner filed suit against Eastern alleging intentional infliction of emotional distress because Eastern allegedly required him to commit federal felonies. - Grant 5 - 0.
7. SER Patricia A. Aldridge v. Dale Humphreys, Warden - 050710 - Petitioner appeals from the circuit court's order denying her petition for a writ of habeas corpus. Petitioner was convicted of first degree murder and sentenced to life without mercy. - Refuse 3 - 2 , Albright & Starcher.
8. SER Joseph A. Buffey v. Michael Coleman, Warden - 050262 - This is a habeas corpus petition wherein petitioner alleges that he entered a guilty plea without the benefit of all evidence in the case being provided to him prior to the entry of his pleas. Petitioner alleged ineffective assistance of counsel, misconduct by the Prosecutor and Clarksburg Police Department, and the discovery of exculpatory evidence. - Refuse 5 - 0.
