5.     Charles Dunn & Florence Dunn v. John Doe, et al., No. 991282 (filed 5-12-99).
    Doe, et al. petitions this Court to affirm the circuit court's ruling on one certified question and reverse that court's ruling on a second certified question arising from a suit filed by the Dunns to collect uninsured and underinsured motorist benefits under a policy issued to them by Allstate of West Virginia.

    The Grosses appeal the dismissal, with prejudice, of their action against Kevin Malone, et al. for defamation, invasion of privacy, intentional and/or negligent infliction of emotional distress, and outrageous conduct, as well as the award of attorney fees to the defendants.

    Taylor appeals the dismissal of his habeas petition below. The lower court dismissed the
    habeas petition without appointing counsel and conducting a Losh hearing.
