Petitioner appeals his 2003 conviction on one count of sexual assault in the first degree, one count of sexual abuse by a custodian, and one count of failure to timely register an address change as a sex offender. His sentence is 25 to 55 years in prison.

15.  West Virginia Coal Mine Safety Board v. West Virginia Office of Miners’ Health, Safety, and Training, No. 081784 (Filed 9/8/08)

Petitioner appeals the lower court’s order reversing the Board of Appeals’ decision lowering a penalty assessment made by the Office of Miners’ Health, Safety, and Training from $100,000 to $10,000. While the court found that the Board exceeded its authority and abused its discretion, Petitioner asserts that the Board had the discretion to reduce the fine.
