1. Sheryl Lynn Jewell v. Lisa Ford, et al. - 30037 - Plaintiff appeals from the circuit court's award of summary judgment in favor of Nationwide. 2. Jack Napier v. Patricia Napier - 30015 - Defendant appeals from the circuit court award of summary judgment in favor of plaintiff in this action for wrongful occupation of residential rental property and from the circuit court's dismissal of defendant's counter-claim for failure to state a cause of action. 3. Sue Ann Shroyer v. Harrison County Board of Education - 30033 - Petitioner appeals from the circuit court's order affirming the decision of the West Virginia Education and State Employee's Grievance Board denying petitioner's grievance. 4. Joseph Tankovits, III v. Lee J. Glessner, et al. - 30028 - Petitioner appeals from the circuit court's order prohibiting the Lee S. Glessner Trust from taking a federal income tax deduction on the Trust's income tax returns for certain transfers and payments made as a part of the settlement agreement. Joseph Tankovits, III, et al. v. Lee J. Glessner, et al. - 30029 - Plaintiffs appeal from the circuit court's Opinion and Order directing that certain settlement proceeds be treated as compensatory damages for tax purposes and from the circuit court's separate Order directing plaintiffs to execute a deed conveying all of their interest in certain real property in return for the appraised value of the "land only" without an exception and reservation for the ownership interest that plaintiffs might have in the buildings and appurtenances on the property. 5. State of W. Va. v. Roy Eddie Slaton, Jr. - 30019 - The petitioner, Roy Eddie Slaton, Jr., challenges his conviction in the Circuit Court of Berkeley County of first degree sexual assault. Specifically, the petitioner, over age 40, was charged and convicted of the sexual assault of a 5 year old boy. The petitioner contends, inter alia, that, based upon the circumstances of this case, the Circuit Court committed error in failing to, sua sponte, order and conduct a pre-trial competency hearing to determine the petitioner's competency to stand trial. - Continued to February 27, 2002. 6. State of W. Va. v. Samuel Aubrey Leep - 30018 - The petitioner, Samuel Aubrey Leep, challenges his convictions returned by a jury in the Circuit Court of Wayne County of sexual offenses against his biological daughter. The convictions include one count of sexual assault in the first degree, one count of sexual abuse in the first degree and two counts of sexual abuse by a parent. 7. State of W. Va. v. Shawna Dawn James - 29990 - Petitioner seeks to appeal conviction of malicious assault based upon instructional error. 8. SER WV Dept. of Health & Human Resources, BCSE, et al. v. James B. Carpenter - 29774 - The petitioner, James B. Carpenter, appeals from an order entered in the Circuit Court of Wood County adopting a Family Law Master's recommendation that the petitioner reimburse the respondent Bureau of Child Support Enforcement for all of the birthing and related medical expenses concerning an infant born to the petitioner and respondent Jennifer Dawn Shepard. The petitioner contends that the Circuit Court's order was discriminatory and violated principles of equal protection.
