Powers and Norva Belcher - 012095 - The petitioners, Randall Floyd Belcher and Charles Eugene Belcher, appeal from an order entered in the Circuit Court of Kanawha County adopting the recommendation of the Special Commissioner that a 1959 reservation in a deed was too indefinite to establish a Belcher family cemetery on a lot owned by the Agee respondents, beyond a small fenced-in cemetery already existing on the property. The petitioners contend that the Circuit Court committed error in ruling in favor of the Agee respondents, since the size of the cemetery the petitioners claimed was clearly established by the recorded deeds and maps in the chain of title.
