            On a former day, to-wit, October 8, 1999, came Darrell E. Holmes, Clerk of the Senate of West Virginia, by Jennifer B. Walker, his attorney, and also came Gregory M. Gray, Clerk of the House of Delegates of the State of West Virginia, by M. E. “Mike” Mowery, his attorney, and presented to the Court their joint brief Amicus Curiae on behalf of the Legislature of West Virginia. Upon consideration whereof, the Court doth hereby order the aforesaid brief Amicus Curiae filed. 

            It is further ordered that Darrell E. Holmes, Clerk of the Senate of West Virginia, and Gregory M. Gray, Clerk of the House of Delegates of West Virginia, file, on or before the 18th day of October, 1999, a brief addressing their authority and authorization to file a brief Amicus Curiae on behalf of the Legislature of West Virginia. Justice Davis deemed herself disqualified and did not participate in the consideration or decision of this matter. Retired Justice Thomas B. Miller and Judge Clarence L. Watt, sitting by temporary assignment.
