September 2004 term ends

Yesterday was Sine Die, the formal end of the September 2004 term of court. As is customary, many opinions were filed this week, with more to come later today and next week. Opinions of interest thus far include PERDUE V. WISE, where the Court unanimously held that a proposed bond sale to redeem pension debt had to be put to a vote, and SER CHEMTALL, et al. v. MADDEN, et al., in which the Court addressed several components of class actions and accrual of medical monitoring causes of action, in the context of personal injury litigation by coal plant preparation workers. Also of interest in the case of SER PODELCO v. TOMBLIN, et al., involving a challenge to the process of approving and adopting the Budget Digest (among other issues), is the Court's order transferring the case to the Circuit Court of Kanawha County for further review.

The January 2005 term will commence on January, the 11th, with a Motion and Argument Docket. Justice Albright will be Chief Justice effective January 1, 2005.
