CRIMINAL :: Prejudicial prosecutorial remarks

STATE v. JAMES PAUL HAMRICK, No. 31669 (Per Curiam)(November 12, 2004). Reversing a conviction for misdemeanor battery imposed by the Circuit Court of Webster County following a jury trial in magistrate court. Holding that the prosecutorial remarks during rebuttal closing argument improperly asserted a personal opinion regarding the justness of the case and the legitimacy of the claims against the appellant. Remanded for new trial.
