Court agrees to review and expedite appeal from economic development grant awardsThe Court today unanimously granted and expedited a petition for appeal arising from the procedures used to appoint a state committee and allocate $200 million in economic development grants. The case, SER WV Citizen Action Group v. WV Economic Development Grant Committee, et al., No. 31125, is set to be argued on March 11 at 2:00 pm, here in Charleston, and all briefs are due by the close of business on March 4. The Court also acted upon several motions that had been filed in the case. - The Kanawha County Commission was granted leave to intervene.
- The City of Wheeling, which had been dismissed from the action by the lower court, was granted leave to file a brief as amicus curiae.
- The American Civil LIberties Union was granted leave to participate as amicus curiae.
- The Marshall University Research Corporation; the Huntington Area Development Council, the Tri-State Transit Authority and Metropolitan Huntington, LLC; Advantage Valley Partners, LLC; Putnam County Development Authority; and the Putnam County Commission were granted leave to file a brief as amici curiae.
- The Affiliated Construction Trades Foundation was granted leave to file a brief as amicus curiae.
