Office of the Clerk Case Topics: Civil Information about WV Supreme Court cases in the area of civil law Ballot contest case to be argued September 24 In an ballot contest case arising out of the upcoming race for county commission in Webster County, the Court on Thursday issued a rule to show cause in prohibition in the case of SER Larry Sandy v. Hon. Gary L. Johnson, sitting by designation as Judge of the Circuit Court of Webster County and Victor McClure, et al., No. 30749 (Chief Justice Davis would refuse). In response to a suit filed by Victor McClure, the circuit court had issued a writ of mandamus requiring the ballot commissioners to remove Larry Sandy's name from the ballot as the democratic candidate for the office of county commissioner, after finding that Mr. Sandy's domicile was not in the appropriate voting district. The Court set a special expedited oral argument in the case for Tuesday, September 24, at 2:00 pm. The proceedings will be webcast live. Also on that day, the Court will be conducting admission ceremonies for new attorneys in four groups at 9, 10, 11, and 12. The admission ceremonies will also be webcast live.
