Mandatory Disposal

 

State law (W.Va. 22C-4-10) requires you to do one of the following with your solid waste:
  • Subscribe to and use a solid waste collection service
  • Have proof that your waste is disposed of at a permitted landfill (33CSR7)

 

What is illegal?

It's illegal to burn solid waste (W.Va. 22-5-3), bury solid waste (W.Va. 22-15-10), dump solid waste in or near a stream or body of water (W.Va. 22-15A-4), dump solid waste into a roadside dump (W.Va. 22-15-10), or create an open dump on your property (W.Va. 22-15-10.)

 

Solid Waste Definition

Solid waste includes but is not limited to newspapers, cans, bottles, garbage, trash, discarded household furniture, appliances, tires, carcasses of dead animals, cigarette butts, shingles, construction and demolition waste and other waste materials.

 

A Warning

Criminal penalties range from fines of $2,500 to $25,000 per day of violation and/or incarceration for up to one year.
