The following information concerns West Virginia's fifty local and regional solid waste authorities and their mandated responsibilities under West Virginia code and Legislative Rules.

CHAPTER 22C, ARTICLE 3, SOLID WASTE MANAGEMENT BOARD.

Chapter 22C Article 3 details the focus, authority and obligations of the West Virginia Solid Waste Management Board.

CHAPTER 22C, ARTICLE 4. COUNTY AND REGIONAL SOLID WASTE AUTHORITIES.

The mandated responsibilities of the solid waste authorities are defined by Chapter 22C, Article 4 of the West Virginia Code. The article established a waste hierarchy of 1) Source Reduction; 2) Recycling, Reuse and Materials Recovery; and 3) Landfilling and clearly stated that the purpose of the Legislature was to enable local citizens to resolve the land-use conflicts which may be created by proposed commercial solid waste facilities through the existing forum of county and regional solid waste authorities.

CHAPTER 22, ARTICLE 15. SOLID WASTE MANAGEMENT ACT.

The basic requirements for solid waste management in West Virginia are defined by W. Va. Code §22-15; Solid Waste Management Act.

CHAPTER 22, ARTICLE 15A. THE A. JAMES MANCHIN REHABILITATION ENVIRONMENTAL ACTION PLAN.

In 2005, Senate Bill 428 created, the A. James Manchin Rehabilitation Environmental Action Plan (REAP) Program which consolidated litter control, open dump elimination and reclamation, waste tire clean up and recycling programs into one program to be maintained by the West Virginia Department of Environmental Protection.

TITLE 54, SOLID WASTE MANAGEMENT BOARD LEGISLATIVE RULES

Solid Waste Management Rules cover local solid waste planning, solid waste facility siting, the issuance of bonds, financing of solid waste facilities and performance standards for Solid Waste Authority owned commercial waste management facilities.

TITLE 33, DEPARTMENT OF ENVIRONMENTAL PROTECTION, OFFICE OF WASTE MANAGEMENT RULES

The Department of Environmental Protection, Office of Waste Management Rules covers the subjects of waste management, sewage sludge, yardwaste, lead acid batteries, waste tires, mandatory disposal, recycling grants and the electronics producer responsibility program. 

TITLE 150, PUBLIC SERVICE COMMISSION LEGISLATIVE RULES

Series 2 rules cover the filling of tariffs for public utilities and common carriers. Series 9 covers the regulations of waste haulers, requirements for the pick up of bulky goods, recycling requirements for waste haulers, certificates of convenience and necessity and many other issues relevant to the waste hauling industry.
