Ban on Electronics: What Manufactures Need to Know
Effective June 6, 2008 all electronic manufacturers wishing
to sell or lease electronics, covered electronics devices
(CEDs), in the state were required to register, and pay a
fee, to the West Virginia Department of Environmental
Protection no later than the first day of January each
subsequent year. Senate Bill 746, passed in 2008 made this
requirement law.
CEDs include televisions, computers or video display devices
with a screen that is greater than four inches measured
diagonally. "Covered electronic device" does not include a
video display device that is part of a motor vehicle, or
that is contained within a household appliance or
commercial, industrial or medical equipment.
The manufacturer has two
options in the registration process.
The first option is that the manufacturer implements
a takeback program for their products that is completely
free to the customer, including shipping, which allows the
manufacturer to pay a lower registration fee.
Manufacturers are required to provide a toll free
number and website address detailing program information on
their takeback process. The second option is that the
manufacturer does not implement a takeback program and pays
a higher registration fee.
Fees generated by the
registration process are placed in the Covered Electronic
Devices Grant Program, which
provides local solid waste authorities, county commissions
and municipalities with funding to provide electronic
recycling opportunities to their communities.
Any manufacturer that
produces an average of more than one thousand covered
electronic devices (CEDs) per year in the previous three
year period is required to register. If they do not register
they are libel for a civil penalty not to exceed ten
thousand dollars per year.
